Minister releases “Statement of Intent” on the Commonwealth’s compliance approach

At the Education Council meeting on 12 June 2020, the Commonwealth Minister for Education undertook to issue a “Statement of Intent” that recognises the impact that the COVI-19 pandemic has had on the delivery of school education in 2020.

Following consultation with Education Council officials on the draft, a final Statement has been released today.

The Statement of Intent is aimed at providing reassurance that a flexible approach to compliance and reporting arrangements will be made where obligations cannot be met due to the unforeseen and unavoidable impact of the pandemic.

It is important to note, however, that not all funding conditions under the Australian Education Act 2013 and the Australian Education Regulation 2013 will be adversely affected by the pandemic, and some conditions may only be affected in minor ways.

The regulatory approach outlined in the Statement of Intent requires states and territories and approved authorities to act in good faith and endeavour to comply with funding conditions as far as practicable. This includes promptly identifying and communicating issues in complying with particular conditions.
